Taxes in the U.S. – Who files what?

If a student on F-1 or J-1 status does not work on campus and has not received payments through an internship. This student only fills out a tax Form 8833 before April 15th of the following year.

If a student works on campus, has earned money through an internship (CPT/OPT) or off campus work (Economic Hardship status), and has paid federal income taxes, then this student fills out a Tax Form 8833 and a 1040NR-EZ Tax Form by April 15th of the following year.

If a student works on campus or has earned money through an internship (CPT/OPT) or off campus work (Economic hardship status), and is from a country that has a tax treaty with the United States (see * below), then this student needs to fill out a Tax Form 8233 when registering to claim the tax treaty deduction. Furthermore, this student fills out a 8833 and a 1040NR-EZ Tax Form by April 15th of the following year.

If a student receives a scholarship in an amount above tuitions and works on campus or has earned money through an internship or off campus work (Economic Hardship status), then this student needs to fill out a W4 and a Tax Form 8233 if registering to claim the tax treaty deduction. Furthermore, this student fills out a 1040NR-EZ Tax Form by April 15th of the following year. In addition, this student will need to reimburse Eckerd College of the tax deduction applied on the scholarship.

If a student receives a scholarship in an amount above tuitions and does not work, then this student needs to fill out a W8-BEN tax form. Part B needs to be filled only if there exist a tax treaty between the US and the student’s country of origin. Furthermore, this student fills out a 1040NR-EZ Tax Form by April 15th of the following year. In case, this student does not have a social security number, then a W7 form needs to be done. In addition, this student will need to reimburse Eckerd College of the tax deduction applied on the scholarship.

Note: Student who needs to fill out a W8-BEN, only need to fill it out once, this is not a yearly form.

* To determine if a student benefits from a tax treaty agreement, look up in the table of IRS publication 901 if the country benefits of a treaty. In that table, if the country is listed, under the label "Category of Personal Services" select the code indicating "Studying and Training" and possibly "Compensation during Training". Then, under the category called "Required Employer or Payer", only the categories indicating or including US resident would qualify. This would give the Code and Article of the applicable treaty.
